Meet Larry

After completion of both undergraduate degree at the University of North Carolina at Chapel Hill as a Morehead Scholar, and his law degree, Larry returned home to Asheville in 1968 to begin his practice. A Fellow in the American College of Trial Lawyers and International Society of Barristers, the major focus of his practice is civil litigation with special emphasis on patent and trademark infringement and antitrust. He also has a significant practice in business law. In addition, Larry represents the utility, development and communication industries in connection with regulation, employment, zoning and related governmental matters throughout Western North Carolina.

Larry’s litigation practice is principally in federal courts in the Southeast and he is a permanent member of the Judicial Conference for the United States Fourth Circuit. He is admitted to practice before the U.S. Supreme Court and various federal district courts and agencies, including all three U.S. District Courts of North Carolina.

Larry has been involved in local government for over 35 years. He served as Mayor and Councilmember of the city of Asheville, County Attorney for Buncombe County and Chair of the Western North Carolina Regional Mental Health Board.

Larry also served as President of the North Carolina Bar Association following terms as President of the 28th Judicial District Bar and Vice-Chair of the State Bar’s initial Board of Specialization. He has maintained close ties with his law school alma mater, UNC, and served as President of its Alumni Association.

For 11 years Larry served as North Carolina’s State Delegate to the American Bar Association House of Delegates, chairing North Carolina’s Delegation to the House. He chaired the ABA’s Commission on Law and Aging and recently completed a term on the ABA Board of Governors, where he served as Chair of its Executive Compensation Committee and on its Finance Committee. He currently serves as Chair of the ABA Standing Committee on Pro Bono and Public Service and sits on the National Pro Bono Task Force of the Legal Services Corporation.

Larry has been instrumental in providing pro bono legal services to those in need on national, state and local levels. He helped found the regional legal services program, Pisgah Legal Services, has served on the board of Legal Services of North Carolina and is immediate past Chair of the North Carolina State Bar IOLTA Board. Larry is also a sponsor of the Genesis Alliance, a non profit organization created to increase awareness of domestic violence.

Larry is a Senior Principal in The Van Winkle Law Firm where he has been active in management and development through service as its President and on its Executive Committee.

Practice Highlights

  • With other counsel, successfully defended satellite programming services provider against patent infringement claims.
  • With other counsel successfully pursued and settled class-action antitrust litigation against several worldwide suppliers of textile product.
  • On behalf of utility company, successfully challenged municipality’s attempt to annex a power plant. Decision by N.C. Supreme Court was case of first impression.
  • With other counsel, successfully pursued manufacturer against another, which resulted in a multi-million dollar settlement for client on the eve of trial.

Work with Larry

Together with his wife, Dershie, a novelist, Larry has three children: Brandon, a speech pathologist who has three children of her own; Trenton, who works in the film industry; and, Kendal, an employee at Appalachian State University in Boone, North Carolina.

Larry's interests include spending time at his second home on Dewees Island near Charleston, South Carolina. Larry is past President of the Deedee Paschal Barrier Island Trust, a 501(c)(3) foundation he helped found to encourage the study and preservation of barrier islands like Dewees.

A skier and avid fly fisherman, Larry is known to be AWOL during a western snowstorm or the mayfly hatch. Since his three children have (allegedly) flown the coop, he and his wife enjoy travel but are always seduced back home to be near their grandchildren.
