Meet Allan

Allan Tarleton has practiced law in Asheville since 1980.  For the last 20 years he has concentrated his practice in the fields of healthcare litigation in the state Superior Courts and workers’ compensation litigation before the North Carolina Industrial Commission and appeals before the state’s appellate courts.

Allan has spent his professional career representing hospitals and other healthcare providers, small and large businesses, and ordinary people.  He has obtained favorable results in jury trials, administrative hearings, and appeals and has proven to be an effective negotiator before trial and in many cases before suit is even filed.

Allan attended undergraduate school at Wake Forest University , graduating cum laude with a B. A. degree in English in 1974.  While at Wake Forest , he participated in studies in Venice, Italy.  He was a staff writer and city editor for the Pulitzer Prize-winning Washington (NC) Daily News before returning to Wake Forest for law school, whence he graduated in 1980.

Practice Highlights

  • Successfully defended hospital from medical negligence claim arising from post-operative procedures.
  • Successfully defended hospital employer from workers’ compensation claim alleging recurrent shoulder injury.
  • Negotiated $700,000 recovery for workers’ compensation claimant against two insurance carriers, each of whom denied coverage of the claim.
  • Negotiated significant settlement on behalf of low-income tenant injured when she stepped through the floor of her rented mobile home.
  • Recovered largest verdict then in Swain County history on behalf of owners of a furnished cabin destroyed by fire. Verdict later sustained on appeal.
  • Successfully defended self-insured manufacturer against workers’ compensation claim alleging permanent brain injury.
  • Recovered a $5 million federal judgment in a satellite TV pirate case.

Work with Allan

Allan is married to Donna Tarleton, a middle school librarian. Their son, Penn, is a student at Elon University School of Law. Allan is a Cross Fit devotee and sometimes triathlete, commuting to the office by bike as much as possible and training regularly throughout the year.

Allan also enjoys hiking with his family and playing golf. He belongs to The Pen & Plate Club, a century old group of professionals and academicians who meet every month for dinner and a member’s essay, and he’s a member of a men’s book club.

Favorite Foods: Anything cooked at home, made from scratch
