Will Contests

The Van Winkle Law Firm assists clients in resolving disputes where the validity of a will is in question.

Such cases often involve the following issues:

  • Whether or not the individual who signed the will lacked the mental capacity required to execute a will.
  • Whether someone unduly influenced the decedent to make a will in their favor.
  • Whether there was fraud or duress in the execution of the will.
  • Whether or not the proper formalities were followed when the will was signed.

The Van Winkle Law Firm brings an experienced team of estate planners and estate litigators to will contest cases and undertakes a thorough investigation of such matters.  Our group works with our clients to determine if early mediation or other alternative means of dispute resolution are appropriate in will contests.

PRACTICE HIGHLIGHTS
