Meet Jones

Jones joined The Van Winkle Law Firm in 1995 after spending over two decades as a partner in a neighboring Asheville firm. Jones’s broad trial practice continues to focus on civil litigation and dispute resolution. In his active eminent domain practice, Jones represents landowners and occasionally one utility condemnor. He also lectures and writes from time to time in the eminent domain field.

Jones is also a certified mediator.

Practice Highlights

  • Represented a bicyclist injured in a crash which produced a multimillion dollar recovery.
  • Helped a Western North Carolina maintenance worker and his wife by obtaining in excess of $1.1 million from a Pennsylvania autoclave door-locking mechanism manufacturer.
  • Served victims of clergy abuse by obtaining recoveries exceeding $1 million and relocating remains of perpetrator.
  • Assisted victims injured on unsafe residential or commercial premises by way of recovering several million dollars for their benefit.
  • Represented an international company defending eminent domain case brought by county government seeking to condemn land for county landfill resulting in jury verdict in client’s favor, implementing total recovery exceeding $1.1 million plus costs.
  • Successfully represented eight landowners with small businesses, raw land and homes in eminent domain cases against NCDOT when their highway frontage was changed due to widening of US Highway, resulting in total recoveries exceeding $2 million, averaging triple the compensation offered by NCDOT.
  • Helped victims of sewer line condemnation by recovering approximately 15 times greater compensation than was offered by sewer authority.
  • Represented convenience store owner against NCDOT resulting in jury verdict over 30 times greater than the compensation offered by NCDOT, excluding interest.
  • Assisted victims of medical malpractice by recovery of significant and several verdicts and settlements.
  • Obtained jury verdict for home owner over twenty-seven times greater than offer initially received from sewer authority for replacement sewer line installed along rear property plus court ordered costs of litigation.
  • Assisted owners of unimproved real estate involved in highway widening project by obtaining, via trial, significant 6 figure recoveries more than 10 times greater than amounts initially offered by NCDOT plus court costs

Work with Jones

Jones is married to Sandra P. Byrd, Ed.D., who is a retired professor, Assistant Provost and Director of the Asheville Graduate Center at the University of North Carolina - Asheville. Their son, Jones P. Byrd, Jr., practices law in Winston-Salem, North Carolina, and their daughter, Julia I. Byrd, is a marine biologist and environmental scientist in Charleston. Jones’s hobbies include bird hunting, fly fishing and cycling. He likes to travel both near and far to participate in these activities.
