David recently relocated to Asheville after practicing for eight years with a firm in South Carolina in commercial litigation. He brings his litigation acumen and experience to Van Winkle’s litigation team, where he is involved in complex commercial and personal litigation.
Practice Highlights
- Represented corporate defendant in adversary proceeding filed in bankruptcy court for alleged fraudulent and preferential transfers by client. Plaintiff claimed more than $7 million in damages. Case successfully resolved prior to trial.
- Represented mortgage lender in contract dispute to recover damages from purchase of mortgage loans. Case involved more than $1 million in damages. Case resolved prior to trial.
- Represented former owner of business in a lawsuit against current owners of business for payment of promissory note and collateral of business. Successfully negotiated within a very short period of time the sale of the business to a third party which preserved the value of the business despite the perishable nature of the goods. Separate action against two former owners was settled prior to trial with a favorable outcome to client.
